Felony offenses are those offenses which have a punishment range of at least one year or greater in a state pentionary. Felony charges are the most serious of criminal charges and have a very specific procedural process, as follows:

• Initial Arraignment
• Preliminary Hearing
• District Court Arraignment
• Either Disposition or Jury Trial or Non-Jury Trial

Throughout the entire process, you will want and need a competent attorney to advise you of what you should do and of your rights.

Misdemeanor offenses are those offenses which carry a punishment of no greater than one year in the county jail and or a fine of no more than a $1000. 

Although misdemeanor offenses may not have the same punishment, they are no less serious; your rights and future rights may be greatly affected.

Some misdemeanor offenses are termed "predicate offenses", which means, the first offense is a misdemeanor. Any second offense is automatically considered a felony offense. These offenses include but are not limited to the following:

• Driving Under the Influence (alcohol/drugs)
• Actual Physical Control
• Domestic Assault and Battery
• Possession of Marijuana
